These terms explain how Sitework's website design service works. They apply when you commission a project from us. We will confirm the agreed scope, timing and any project-specific details in writing before work starts.
1. Who we are
Sitework is operated by Jacob Orsborn-Smith, a sole trader trading as Sitework in the United Kingdom. In these terms, “we”, “us” and “our” mean Sitework. “You” and “your” mean the person or business commissioning the work.

2. The service and current price
We design and build bespoke websites for UK trade businesses. The standard offer shown on this site is:

Every plan includes the build itself, hosting, domain renewal, SSL, routine security and backups, plus unlimited small text and photo changes. It does not include substantial new pages, a redesign, paid advertising, paid software or third-party subscriptions. If extra work is needed, we will explain it and agree the price with you before starting.
3. Free mockups, no obligation
Before you commission a site, we may prepare mockups based on the details you give us. Mockups are free and there is no obligation to proceed. Until a project is agreed and paid for, concepts, designs and mockups remain our property and must not be copied, published or given to another designer for use.
4. Payment and starting work
Once you approve a design direction and we confirm the project in writing, we build the site. There is nothing to pay until it is live. Your plan is then charged in advance every four weeks from launch. If you are not happy with the finished site, your first payment is refunded.
We may pause work, delay launch or suspend the care service while an invoice remains overdue. This does not remove your responsibility to pay for work already agreed or delivered.
5. Your role in the project
You are responsible for providing accurate business details, content, photographs, logos and approval in reasonable time. You confirm that you have the right to use everything you supply and that it does not infringe another person's rights, mislead customers or break the law.
We will ask questions and guide the process, but delays in receiving copy, photos, permissions or feedback may move the delivery date.
6. Ownership and third-party materials
Your business content, including your logo, text and photos, remains yours. You may use the finished site for your business while your plan remains active. After twelve continuous months on a plan, ownership of the website files and the domain transfers to you and you may keep the site whether or not you continue.
Some parts of a site may be subject to third-party terms, such as fonts, images, plug-ins or maps. Those materials remain subject to their own licences. We will not knowingly use material that requires you to break those terms.
7. Cancelling your plan
Plans run for a three month minimum and are rolling after that. You can cancel by telling us in writing and it will end at the close of the paid period. If you cancel inside the first twelve months we will take the hosted site offline when it ends, unless we agree a handover or alternative hosting arrangement with you. After twelve months the site and the domain are yours and are transferred to you on request at no charge.
If you want to move elsewhere, ask us before the end of the paid period. We will provide a reasonable handover of the site files and the information needed to transfer the domain where we control it. Any additional migration or third-party set-up work will be discussed and agreed with you first.
8. Cancellation rights for consumers
Sitework is aimed at businesses, but if you are contracting as a consumer, you may have statutory cancellation rights. Where applicable, we will provide the required information and obtain your express request before beginning services during any cancellation period. Nothing in these terms removes rights that the law gives you.
9. Results, availability and liability
Except for the Google Maps guarantee in clause 10, we build sites carefully but we cannot guarantee a particular Google ranking, amount of traffic, number of enquiries, or uninterrupted availability of third-party services. Search engines, browsers, hosts, telecoms networks and directories are outside our control.
To the extent allowed by law, our total liability relating to the service is limited to the amount you paid us for the service that gave rise to the claim. We are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data. Nothing in these terms limits liability that cannot lawfully be limited or excluded.
10. The Google Maps guarantee
This clause applies only to the Google Maps Pack, billed at £300 every four weeks, or £350 every four weeks with a website. It does not apply to any other plan.
What is guaranteed. Before work starts we agree in writing one search term and one area, following a free scan of your market. We guarantee that within 90 days your business will reach an average position of 3 or better in Google Maps results for that search term, measured by a geo-grid scan of 49 points (7 by 7) across the agreed radius, centred on your business location.
When the 90 days start. The 90 days start on the day we have working access to your Google Business Profile and, where relevant, your website.
If the target is not reached. The payments for the first three billing periods remain due. If the agreed average position has not been reached by the end of day 90, we will not charge you for further billing periods and will keep working on the agreed search term at no cost until a scan shows the target has been reached. Normal billing then resumes from the next billing period. The guarantee is continued work at no charge, not a refund.
Conditions. The guarantee applies while your Google Business Profile is verified and not suspended, your business has a genuine address or service area within the agreed area, you give us the access we ask for within 7 days of confirming the project, you tell us before making changes to the profile that affect the agreed work, and you share the review link with genuine customers. We will never use fake reviews or any practice that breaks Google's guidelines, and the guarantee never depends on you doing so.
Pauses. The 90 day period, and any period of work at no charge, pauses while your profile is suspended, while access we need is unavailable, or for a reasonable period after a significant change Google makes to how Maps results work. It continues once the issue is resolved.
Ending the plan. After the three month minimum you can cancel as set out in clause 7. If the plan ends, the guarantee ends with it.
11. Portfolio use
We may show completed work and a truthful review in the Sitework portfolio or marketing. If you would prefer that we do not, tell us before launch and we will respect that preference.
12. Governing law
These terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction over any dispute, except where consumer law gives you a different right.
13. Changes to these terms
We may update these terms from time to time. The version in force when we confirm your project applies to that project unless we agree a change with you in writing.
